SPECIAL MEETING MINUTES
TOWNSHIP OF NIPISSING

Friday November 26, 2010

A special meeting of the Township of Nipissing Council was held on Friday, November 26, 2010 at the Township of Nipissing Office.

Present: Mayor Wendy Prieur and Councillors Dougal Culham, Pat Haufe and Leslee Lawrence Straus.

Regrets: Kalvin Young

Staff and visitors present: Charles Barton, Doug Walli, Tom Piper, John-Paul Negrinotti and Roland Dagenais.

The meeting was called to order at 9:00 a.m.

Disclosure of pecuniary interest: None.

R2010-277 D. Culham, P. Haufe: Whereas consent to sever application No. B/54/Nipissing/2010, applicants: Roland and Rea Dagenais, has been submitted to the North Almaguin Planning Board;

And, whereas The Township of Nipissing Official Plan, Schedule ‘B’ Sensitive Areas has identified a Landfill adjacent to the applicants property;

And whereas Section 2.1.7 and 2.5.2 of The Township of Nipissing Official Plan identifies the need for certain studies to be completed;

And whereas it is the responsibility of the applicant to provide the municipality with all of the pertinent documentation in support of the consent to sever application so they may assess the proposal for conformance to provincial guidelines;

And whereas Council, to date, has not received the appropriate studies, which will determine whether the subject application has met the requirements of the provincial guidelines;

And whereas the Ministry of the Environment Guideline D-4 specifies restrictions and controls on land use that the ministry wishes to see implemented in the vicinity of landfills and dumps, in order to protect the health, safety, convenience and welfare of residents near such facilities.

And whereas the Ministry of the Environment Guideline D-4, Section 5.1 will normally recommend against proposals for sensitive land use, such as a permanent structure where a person sleeps, adjacent to operating landfills;

And whereas Council believes the proposed application is not in the public interest in accordance with Section 51(24) of the Planning Act and it does not conform to the Official Plan of the Township of Nipissing.

Now therefore the Council of the Township of Nipissing recommends that the subject application be refused.

R2010-280 D. Culham, P. Haufe: That we pass By-law No. 2010-77, being a by-law to confirm the proceedings of Council at its meeting held on November 26, 2010.

Read a first, second and third time and passed this 26th day of November, 2010.
