THE CORPORATION OF THE TOWNSHIP OF NIPISSING

BY-LAW NO.1128

BEING A BY-LAW TO DEEM LOTS 45 AND 46 ON PLAN M-428 NOT TO BE LOTS OR BLOCKS ON A PLAN OF SUBDIVISION AT THE REQUEST OF THE REGISTERED OWNERS ROB AND SHELLY ANDERSON

WHERE AS the Municipality has the right to deem Lots or Blocks on a Registered Plan of Subdivision more then eight years old not to be Lots or Blocks on a Registered Plan of Subdivision pursuant to Section 50 (4) of the Planning Act;

AND WHERE AS the owners of Lots 45 and 46 on Plan M-428 have applied to have a Deeming By-Law passed with respect to those properties so as to combine them to allow a single structure to be built in the middle without violating side yard set backs;

NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP NIPISSING ENACTS AS FOLLOWS:
l.Lots 45 and 46 on Plan M-428 being, Parcels 14987 and 14986 in the Register for Parry Sound North Section, are hereby deemed not to be Lots or Blocks on a Plan of Subdivision. In the future it will require Planning Act Consent for these lands to be dealt with separately from each other.
2.This By-Law comes into effect upon its registration on title to the lands described herein.
