BY-LAW NO. 2007- 1206

Shore Road Allowance, Lot 10, Concession 18

Being a by-law with respect to the conveyance of part of the shore road allowance in Lot 10, Concession 18. (Sheffield)

LEGISLATION

1. WHEREAS this Council has approved in principle the closing and sale of part of the shore road allowance in front of Lot 10, Concession 18 to three (3) adjacent owners, namely, Sage Homes Limited, the Sheffields and Margaret Charlton;

2. AND WHEREAS by inadvertence, the Sheffield residence is situated partly on the shore road allowance and within 1.86 feet of what would be the southern boundary of their property if it was extended westerly across the shore road allowance;

3. AND WHEREAS this Council deems it appropriate to convey an additional area of the road allowance to the Sheffields to provide an adequate side yard to the south side of their residence.

BE IT ENACTED AS A BY-LAW OF THIS CORPORATION AS FOLLOWS:

1. That with one exception, the side yard lot lines of the lands owned by Sage Homes Limited, the Sheffields, and Margaret Charlton shall be extended in a straight line across the 66 foot shore road allowance.

2. The exception shall be the southerly boundary of the lot owned by the Sheffields. This boundary shall include a 10 foot area, which area is designated as Part 5 on a plan prepared by Miller & Urso Surveying Inc. dated October 23, 2007. A partial draft of which survey is attached hereto as Schedule “A”.

THIS BY-LAW READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS THE DAY OF , 2007.
