THE CORPORATION OF THE TOWNSHIP OF NIPISSING

BY-LAW NUMBER 2008-1234

Being a By-Law to authorize the carrying on of a Community Programme of Recreation within the meaning of the regulations under the Ministry of Tourism and Recreation Act, R.S.O. 1990, c. M.35, and to provide for the establishment, operation and maintenance of Community Centres pursuant to the Community Recreation Centres Act, R.S.O. 1990, c. C.22, and regulations thereunder.

(1) The Council of the Corporation of the Township of Nipissing ENACTS AS FOLLOWS:

(a) Pursuant to Regulations made under the Ministry of Tourism and Recreation Act, a Community Programme of Recreation is hereby established for the residents of the Township of Nipissing.

(b) Pursuant to the Community Recreation Centres Act and the regulations made thereunder, a Community Centre is hereby established for the residents of the Township of Nipissing.

(c) The said Community Programme of Recreation and the said Community Centre shall be directed, managed and controlled on behalf of the Council of the Corporation of the Township of Nipissing by a Committee known as the Township of Nipissing Recreation Committee.

(2) The Recreation Committee shall be appointed annually by the Council of the Corporation of the Township of Nipissing at their first regular meeting, or as soon thereafter, as is expedient. The term of office shall be for one year.

The Recreation Committee: Two members of the Council, a minimum of six and maximum of eight residents of the Township of Nipissing who are qualified to be elected as members of the Council.

(3) The functions of the Township of Nipissing Recreation Committee are outlined in Schedule A attached hereto and declared to be part of this by-law.

(4) By-law No. 1053 is hereby repealed. This by-law shall come into effect upon approval of the Ministry of Tourism and Recreation.

TOWNSHIP OF NIPISSING RECREATION COMMITTEE

(1) The Township of Nipissing Recreation Committee may make rules and regulations for the conduct of the community programme of recreation or any part thereof and to govern the conduct of all persons who in any way participate in or be in attendance at any part of the programme.

(2) The said Committee shall assist in the co-ordination of community recreational activities.

(3) Appointment to the Recreation Committee will be made by giving consideration to the area in which the applicant resides and/or where their interest in promoting recreation exists, to provide representation from all areas of the Municipality.

(4) The Recreation Committee shall elect a Chairperson annually from its members, and such other officers as may be required.

(5) A majority of the members of the Committee shall be a quorum (50% + 1).

(6) When advisable, the said Committee may appoint area recreation committees, of no more than three persons, to work with members of the Committee to establish and operate area community programmes of recreation. The Chairperson of the Committee shall submit the names of those chosen to serve on area committees for Council’s approval, by February 1st of each year. The Committee shall provide such services as it deems necessary to assist these area committees in carrying on their activities. These area committees should meet monthly and shall include members of the Township of Nipissing Recreation Committee.

(7) The Committee shall, on or about the 1st day of February in each year, submit a budget to Council, for its approval.

(8) The Committee shall hold a minimum of four general meetings per year. It shall be the responsibility of the Chairperson to set the date and time of these meetings, and to ensure that all members are notified.

(9) The said Committee may incur expenditures, as may be recommended by various committees, to the extent provided in the annual approved budget, or as specifically approved by Council.

(10) The Township of Nipissing Recreation Committee shall, on behalf of the Council, be responsible for the administration and management of the Nipissing Community Centre.

(11) The Committee may make such rules as it considers necessary relating to the management and control of the Centre, and may fix such charges for the use of the Centre, as it considers advisable, subject to the approval of Council.
