TOWNSHIP OF NIPISSING

Tuesday, July 16, 2013

A regular meeting of the Township of Nipissing Council was held on Tuesday, July 16, 2013.

Present: Mayor Pat Haufe and Councillors Tom Butler, Dougal Culham, Tom Piper and Liz Smith.

Staff and visitors present: Ray Winterstein; Karl Winterstein Sr.; Ray Winterstein Jr.; Will Bateman; Dave Yemm; John-Paul Negrinotti; Charles Barton and Kris Croskery-Hodgins.

Guests: Wayne Simpson, President, Hawkestone Development Corporation

The meeting was called to order at 6:30 p.m.

Disclosure of pecuniary interest: Councillor Tom Butler and Councillor Liz Smith.

A review of comments received to date regarding proposed changes to the speed limits on Municipal roads took place.

Presentation: Wayne Simpson, President of Hawkestone Development Corporation gave a presentation regarding an update of the development of the property owned by the Corporation within the Township of Nipissing.

R2013-149 L. Smith, T. Piper: That the minutes of the meeting held June 25, 2013 be adopted as published. Carried.

R2013-150 D. Culham, T. Butler: Be it hereby resolved that the Corporation of the Township of Nipissing accepts the agreement of the Subscription policy to insure the liability assumed by this Resolution as follows:

The Corporation of the Township of Nipissing hereby:
1. Assumes the liability for bodily injury to or death of any person or damage to or destruction of property of others, imposed by law upon:
a) Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers of the Corporation of the Township of Nipissing for liability which arises out of the use or operation by such person of a licensed motor vehicle, or
b) the owner of any licensed motor vehicle, for liability which arises out of the use or
operation of such licensed motor vehicle by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers of the Corporation of the Township of Nipissing.

2. Declares that such assumption of liability be subject to the following limitations, exclusions and conditions:
a) This assumption of liability applies only to the use or operation of a licensed motor vehicle in Canada or the United States of America by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers on behalf of the Corporation of the Township of Nipissing including travel to and from work and attendance at meetings.
b) This assumption of liability applies only in excess of existing insurance carried by the owner of the licensed motor vehicle which was being used or operated by Members of Council, Commissioners, Trustees, Board Members, Statutory Officers, Officers, Employees or Volunteer Workers at the time of the accident and does not apply unless the licensed motor vehicle which was being used or operated by such person at the time of the accident is insured for not less than the minimum Third Party Liability Limit required by The Insurance Act for the Province of Ontario.
c) This assumption of liability is subject to the agreements, conditions, terms and limit of liability insured in the Non-Owned Automobile Policy issued by the Subscription Policy and shall terminate whenever such Non-Owned Automobile Policy is terminated.

R2013-151 L. Smith, T. Piper: That we authorize the CAO-Clerk, the Mayor and EDO/CEMC/Planning Assistant to attend the Northeastern Ontario Planning Authorities Technical Workshop 2013 in Sudbury. Carried.

Councillor Liz Smith declared pecuniary interest for the discussion of Alternative Voting Methods as she is employed by Canada Post Corporation, which would be affected by a change to current voting procedures.

A discussion took place presenting alternative voting methods for the 2014 Municipal Election.

R2013-152 T. Piper, L. Smith: That we accept the correspondence as presented. Carried.

Councillor Tom Butler declared pecuniary interest as his spouse is listed in the Accounts Payable as an employee.
Councillor Liz Smith declared pecuniary interest as her employer is listed in the Accounts Payable.

R2013-153 T. Piper, D. Culham: That the statement of accounts dated: July 4 and 16, 2013, totaling $200,731.37, be approved. Carried.

R2013-154 D. Culham, T. Butler: That we authorize and direct the Fire Chief to request the Office of the Fire Marshal to conduct a review of the Shared Fire Services for The Corporation of the Municipality of Callander and The Corporation of the Township of Nipissing. Carried.

R2013-155 L. Smith, T. Piper: That we authorize the payment of $1,000 to Animal Control Officer, Sandy Briggs, for the upgrades required to dog impound facilities. Carried.

R2013-156 L. Smith, T. Piper: That we authorize the Treasurer-Deputy Clerk to enroll in the Municipal Law Program, Unit 2. Carried.

R2013-157 T. Butler, D. Culham: That we pass By-Law No. 2013-25, being a by-law to confirm the proceedings of Council at its meeting held on July 16, 2013. Read the first, second and third time and passed this 16th day of July, 2013. Carried.

R2013-158 T. Piper, L. Smith: That the meeting be adjourned. Time: 9:03 p.m. Next regular meeting August 13, 2013. Carried.
