TOWNSHIP OF NIPISSING

A regular meeting of the Township of Nipissing Council was held on Tuesday, May 19, 2009.

Present: Mayor Wendy Prieur and Councillors Kalvin Young, Leslee Lawrence Straus, Pat Haufe and Dougal Culham.

Staff and visitors present: Charles Barton, Danny Rodgers, Dave Yemm, Ken Grant, Bob Rice, Kylie Winterstein, Russ Charlton, and Kris Croskery.

The meeting was called to order at 6:30 p.m.

Disclosure of Pecuniary Interest: Councillor Lawrence Straus declared a pecuniary interest for item #9 on the agenda, Near North Heritage Group.

R2009-143 K. Young, L. Lawrence Straus: That the minutes of May 5, 2009 be adopted as published. Carried.

R2009-144 D. Culham, P. Haufe: That we pass By-Law No. 2009-33, being a by-law to confirm the proceedings of Council at its meeting held on May 5, 2009. Read the first, second and third time and passed this 19th day of May, 2009. Carried.

R2009-145 K. Young, L. Lawrence Straus: That we accept the tender number N-01-09 submission from P.D. Brooks Haulage & Construction. In the amount of $163,000.00. Carried.

R2009-146 L. Lawrence Straus, K. Young: That we pass By-Law #2009-34, being a by-law to approve the Standard Operating Guideline for Personal Protection Equipment for the Nipissing Fire Department. Carried.

R2009-147 P. Haufe, D. Culham: That Council will support in principal an application submitted by James E. Bartraw (Trustee) for the closure of the shore road allowance abutting property located at Concession 18, Part Lot 10, PCL 6554 in the Township of Nipissing, District of Parry Sound subject to:

1) the applicant providing an environmental report specifying the geographic limits where development could occur and compliance to the Provincial Policy Statement, and
2) all costs to be borne by the applicant.
Carried.

R2009-148 K. Young, L. Lawrence Straus: That Council will support in principal an application submitted by James E. Bartraw (Trustee) for the closure of the abandoned road and trespass road abutting property located at Concession 18, Part Lot 10, PCL 6554 in the Township of Nipissing, District of Parry Sound subject to:

1) this application and the shore road allowance application shall be completed concurrently, and
2) all costs to be borne by the applicant.
Carried.

Councillor Leslee Lawrence Straus declared Pecuniary Interest for the Near North Heritage Group as she is the Chairperson. Councillor Lawrence Straus left the room.

R2009-149 D. Culham, P. Haufe: That we donate $400.00 to the Near North Heritage Golf Tournament. Carried.

Councillor Straus returned to the room.

R2009-150 D. Culham, P. Haufe: That this part of our meeting will be closed to the public as authorized by Section 239(2) of the Municipal Act, 2001, c. 25, for consideration of the following subject matter:

b) personal matters about an identifiable individual, including municipal or local board employees;

R2009-151 K. Young, L. Lawrence Straus: That we resume to an open public meeting. Time: 8:55 p.m. Carried.

R2009-152 D. Culham, P. Haufe: That we accept the resignation of Bob Rice as Fire Chief and Fire Fighter from the Nipissing Township Fire Department. Carried.

R2009-153 K. Young, L. Lawrence Straus: That we pass By-law 2009-35 to terminate the position of Fire Chief to be replaced with the position of Acting Fire Chief. Carried.

R2009-154 D. Culham, P. Haufe: That we accept the correspondence as presented. Carried.

R2009-155 K. Young, L. Lawrence Straus:
WHEREAS the Township of Nipissing supports practices that contribute to the creation of a sustainable environment;

AND WHEREAS Homegrown OntarioTM is a brand that allows Ontario consumers to support Ontario farmers by purchasing Ontario produced meat and poultry;

AND WHEREAS Ontario farmers adhere to the highest quality standards set forth by the Canadian Provincial and Federal government regulatory boards;

THEREFORE BE IT RESOLVED THAT the procurement practice of the purchasing meat and poultry produced by Ontario farmers be identified as the preferred local sustainable procurement practice.

BE IT FURTHER RESOLVED THAT the purchase of all Ontario produced meat and poultry sourced locally requires the burning of less fossil fuel than food trucked or even flown in from hundreds or even thousands of miles away.

R2009-156 D. Culham, P. Haufe: That the statement of accounts dated May 19, 2009 be approved. $71,919.23. Carried.

R2009-157 K. Young, L. Lawrence Straus: That the Treasurer-Deputy Clerk be authorized to apply for the Recreational Infrastructure Canada (RInC) Program for upgrades and repairs to the Township of Nipissing Community Centre;
And that we attest that the project would not have been completed by March 31, 2011 without the Federal and Provincial funding requested.
The municipality is aware that this program requires a 1/3 municipal contribution. Carried.

R2009-158 D. Culham, P. Haufe: That we approve Consent Application NO. B/23/Nipissing/2009.
Applicant: William and Barbara Johnston.
The lot must comply with the consent Policies of Section 5.2.2 and 5.2.3 in the Township of Nipissing’s Official Plan. Any traveled road situated on the subject property should be transferred to the municipality for road purposes. Carried.

R2009-159 L. Lawrence Straus, K. Young: That we appoint John Cobb as a member of the Township of Nipissing Fire Department. Carried.

R2009-160 P. Haufe, D. Culham: That we appoint Chris Topham as a member of the Township of Nipissing Fire Department. Carried.

R2009-161 L. Lawrence Straus, K. Young:
WHEREAS the Acting Fire Chief has advised that a certain Fire Fighter is no longer an active member;
NOW THEREFORE the following Fire Fighter shall be removed from our roster.
