THE CORPORATION OF THE TOWNSHIP OF NIPISSING

BY-LAW NUMBER 1021

Being a By-law to enter into an agreement for the appointment of an Animal Control Officer for the Township of Nipissing.

WHEREAS the Township has the authority to manage its staffing requirements pursuant to Section 207, Paragraph 45 of the Municipal Act.

AND WHEREAS the Township wishes to arrange by contract for the provision of a part-time Animal Control Officer at an on-call basis.

NOW THEREFORE the Council of the Corporation of the Township of Nipissing ENACTS AS FOLLOWS:

1. Sandy Briggs is hereby appointed Animal Control Officer and a By-Law Enforcement Officer for the purpose of enforcing the provisions of By-Law No. 831 for the licensing and control of dogs within the Municipality and related functions under any Provincial Act.

2. That the Township enter into the Agreement annexed hereto as Schedule “A” with Sandy Briggs.

3. That the Reeve and Clerk are hereby authorized and directed to execute the Agreement on behalf of the Township of Nipissing.

READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 20TH DAY OF NOVEMBER, 2001.

THIS AGREEMENT made as of the 20th day of November, 2001.

BETWEEN:

THE CORPORATION OF THE TOWNSHIP OF NIPISSING
(herein referred to as the “Township”)

of the first part

– and –

SANDY BRIGGS
(herein referred to as the “Animal Control Officer”)

of the second part

WHEREAS

1. The Corporation of the Township of Nipissing has enacted By-Law 831, being a by-law for the licensing and control of dogs within the municipality.

2. The Township wishes to appoint Sandy Briggs on a contract for services basis as Animal Control Officer.

NOW THEREFORE THIS AGREEMENT WITNESSETH:

1. In consideration of the mutual covenants herein contained, the Animal Control Officer hereby agrees to provide the township services shown in Schedule “1” attached hereto.

2. In consideration of providing the said services, the Township agrees to pay, on a contract basis for the services, the amounts set forth in Schedule “1” attached hereto.

3. Sandy Briggs shall serve at the pleasure of Council, subject to the terms and conditions set out herein. This Agreement may be terminated, just cause excepted, upon twenty-eight (28) days notice in writing by either party.

TO WITNESS THIS AGREEMENT, the parties have hereunto set their hands and seals this 20th day of November, 2001.
