TOWNSHIP OF NIPISSING
Tuesday, February 6, 2018
A regular meeting of the Township of Nipissing Council was held on Tuesday, February 6, 2018.
Present: Mayor Tom Piper, Councillors Linda Andersen and Tom Marchant.
Regrets: Councillors Tom Butler and Liz Smith.
Staff and visitors present: Sgt. Jeff Lawson, O.P.P., Dave Yemm, Will Bateman, John-Paul Negrinotti, Kris Croskery-Hodgins and Charles Barton.
The meeting was called to order at 6:30 p.m.
Disclosure of pecuniary interest: None.
Discussion: A request for Council consideration of a noise by-law for the Township of Nipissing was received. The issues of gunfire during daytime hours outside of a defined hunting season, noise from a public beach and continued use of machinery on private property were provided.
The Ontario Provincial Police were requested to attend the meeting to provide information to Council to define an acceptable noise level and time. Sgt. Lawson explained that the normal time for enforcement of a noise by-law begins at 11 p.m.; noise complaints in this area are limited. The intent to annoy or disrupt is required to follow-up on a nuisance noise complaint and in order to follow up on a dangerous discharge of a firearm complaint, the police must determine that it was dangerous.
Noise By-Laws from surrounding municipalities were collected for review. Council has performed due diligence in the investigation of the matter and as there have been no other requests has determined not to proceed.

R2018-026 L. Andersen, T. Marchant: That the minutes of the meeting held January 16, 2018 be adopted as published. Carried.
R2018-027 T. Marchant, L. Andersen: That the minutes of the closed session meeting held January 16, 2018 be adopted. Carried.
R2018-028 L. Andersen, T. Marchant: That we accept the Proposed Modifications to the Official Plan as provided by the Ministry of Municipal Affairs. Carried.

R2018-029 T. Marchant, L. Andersen: That we recommend consent application No. B/1/NIPISSING/2018, Lot Addition, applicants Paul Goodridge – Goodridge Goulet Planning & Surveying Ltd. for property owner Donna Coburn, for approval subject to the following conditions:
1. The lot must comply with the Township of Nipissing’s Official Plan policies.
2. Any public roads located on the owner’s property shall be transferred to the Municipality. Official Plan section 3.3.2.7. and 3.3.2.8.
3. A copy of the decision of the North Almaguin Planning Board be forwarded to the Township of Nipissing. Carried.
R2018-030 L. Andersen, T. Marchant: That we participate in the City of North Bay’s Household Hazardous Waste Program for 2018. Carried.
R2018-031 T. Marchant, L. Andersen: That we accept the correspondence as presented. Carried.
R2018-032 L. Andersen, T. Marchant: That the statement of accounts dated: January 25 and February 6, 2018; totaling $147,045.59, be approved. Carried.
R2018-033 T. Marchant, L. Andersen: That we pass By-Law Number 2018-09, being a By-Law to appoint an officer for the purpose of the enforcement of the Building Code Act, its regulations and the Building By-Law for The Corporation of the Township of Nipissing. Carried.
R2018-034 L. Andersen, T. Marchant: That we authorize the purchase of extrication equipment from the City of North Bay Fire Department in the amount of $10,000. Carried.
R2018-035 T. Marchant, L. Andersen: That we appoint Kathy Shaw as a member of the Township of Nipissing Recreation Committee. Carried.
R2018-036 L. Andersen, T. Marchant: That we accept a proposal from the Powassan District Union Public Library to place surplus amounts from the 2017 Budget into a Reserve for coverage of future deficits. Carried.
R2018-037 T. Marchant, L. Andersen: That we pass By-Law No. 2018-10, being a by-law to confirm the proceedings of Council at its meeting held on February 6, 2018. Read the first, second and third time and passed this 6th day of February, 2018. Carried.
R2018-038 L. Andersen, T. Marchant: That the meeting be adjourned. Time: 8:23 p.m. Next regular meeting February 20, 2018. Carried.
