TOWNSHIP OF NIPISSING

Tuesday, April 3, 2012

A regular meeting of the Township of Nipissing Council was held on Tuesday, April 3, 2012.

Present: Mayor Pat Haufe and Councillors Tom Piper, Thomas Butler, Dougal Culham and Liz Smith.

Staff and visitors present: Superintendent Jim Szarka, OPP; Staff Sgt. Irving Sloss, OPP; Dean Decaire, BDO Canada; Margaret Hughes; Jack Bartraw; Emerson Bartraw; Joan Bartraw; John-Paul Negrinotti; Dave Yemm; Kris Croskery-Hodgins and Charles Barton.

The meeting was called to order at 6:30 p.m.

Committee Reports:

Presentation of the Ontario Provincial Police 2011 Annual Report by Sgt. Irving Sloss.
Superintendent Szarka provided supplementary information for the region.

Presentation of the 2011 Financial Statements by the Municipal Auditor, Dean Decaire, BDO Canada LLP.

R2012-78 L. Smith, T. Piper: That the minutes of the meeting held March 20, 2012 be adopted as published. Carried.

R2012-79 T. Butler, D. Culham: That we pass By-law Number 2012-17 being a By-law to stop up, close and sell part of the Original Shore Road Allowance in front of Lot 3, Concession 19, Township of Nipissing, District of Parry Sound, being Part 2 on Plan 42R-19579. (Hughes)
Read a first, second and third time and passed this 3rd day of April, 2012. Carried.

R2012-80 T. Piper, L. Smith: That we pass By-law Number 2012-18 being a By-law to stop up, close and sell part of the Original Shore Road Allowance in front of Lot 3, Concession 19, Township of Nipissing, District of Parry Sound, being Part 1 on Plan 42R-19579. (Rainville)
Read a first, second and third time and passed this 3rd day of April, 2012. Carried.

R2012-81 D. Culham, T. Butler: That we pass By-law Number 2012-19 being a By-law to stop up, close and sell part of the Original Shore Road Allowance in front of Lot 19, Concession 18, Township of Nipissing, District of Parry Sound, being Part 1 on Plan 42R-19304.
And
Being a By-law to stop up and close part of the Original Colonization Road in Lot 10, Concession 18, Township of Nipissing, being Part 3 on Plan 42R-19304. (Bartraw)

R2012-82 L. Smith, T. Piper: BE IT RESOLVED:
1. that this Council does approve “in principle” the Application of Rhonda Levine Montagnes to purchase the Shore Road Allowance in front of their property, described as PSR 1863 Part 1, located at Concession 18, Part of Lot 11, Township of Nipissing.
2. that this resolution is subject to the following conditions:
• the Council shall select an independent search firm specializing in fishery issues and environmental issues to complete an independent investigation and report to determine the geographic limits where development could occur and to ensure compliance to the Provincial Policy Statement.
• That the applicant will be responsible for the payment of all the Municipality’s administrative, legal accounts and Environmental Impact Study costs in connection with the processing of this application.
• That in accordance with the Municipality’s policy, notice and a copy of the draft plan will be mailed to the adjacent owners.
• That the area be subject to Site Plan Control. Carried.

R2012-83 T. Butler, D. Culham: BE IT RESOLVED:
1. that this Council does approve “in principle” the Application of James Morris Montagnes and Rhonda Shellie Montagnes to purchase the Shore Road Allowance in front of their property, described as Parcel 6833 NS, located at Concession 18, Part of Lot 11, Township of Nipissing.
2. that this resolution is subject to the following conditions:
• The Council shall select an independent search firm specializing in fishery issues and environmental issues to complete an independent investigation and report to determine the geographic limits where development could occur and to ensure compliance to the Provincial Policy Statement.
• That the applicant will be responsible for the payment of all the Municipality’s administrative, legal accounts and Environmental Impact Study costs in connection with the processing of this application.
• That in accordance with the Municipality’s policy, notice and a copy of the draft plan will be mailed to the adjacent owners.
• That the area be subject to Site Plan Control. Carried.

R2012-84 T. Piper, L. Smith: That Council does approve “in principle” an application submitted by Susan Cunningham, Executrix for the Estate of Stanley Toeppner for the purchase of part of the original road allowance between Concessions 4 & 5 within Lot 24 described as Part 2 on draft Plan 42R-__, copy attached, in the Township of Nipissing, District of Parry Sound subject to:
a) That the Applicant will be responsible for the payment of all the Municipality’s administrative, land and legal costs in connection with the processing of the application.
b) The sale price of the land shall be $15 per lineal foot for the average width of the said parcel. Carried.

R2012-85 D. Culham, T. Butler: That we recommend consent application No. B/8/Nipissing/2012, applicant Ronald Leigh Best, for approval. The lot must comply with the consent Policies of Section 5.2.2. and 5.2.3. in the Township of Nipissing’s Official Plan. Any travelled road situated on the subject property should be transferred to the municipality for road purposes. Carried.

R2012-86 L. Smith, T. Piper: That we support consent application B/5/Nipissing/2012, Estate of Stanley Toeppner. The support is conditional on:
1. The successful purchase of a portion of the unopened road allowance between the subject lot (Lot 24, Concession 3) and the lot addition application B/4/Nipissing/2012.
2. 33’ from the centre line of any travelled road situated on the subject property should be transferred to the municipality for road purposes.
3. Any building located on said road should have an encroachment agreement or be removed. Carried.

R2012-87 T. Butler, D. Culham: That we recommend, consent application No. B/6/Nipissing/2012, applicant Estate of Stanley Toeppner, for approval. The lot must comply with the consent Policies of Section 5.2.2. and 5.2.3. in the Township of Nipissing’s Official Plan. Any travelled road situated on the subject property should be transferred to the municipality for road purposes. Carried.

R2012-88 T. Piper, L. Smith: That we recommend, consent application No. B/7/Nipissing/2012, applicant Estate of Stanley Toeppner, for approval. The lot must comply with the consent Policies of Section 5.2.2. and 5.2.3. in the Township of Nipissing’s Official Plan. Any travelled road situated on the subject property should be transferred to the municipality for road purposes. Carried.

R2012-89 D. Culham, T. Butler: That we support addition to a lot consent application B/4/Nipissing/2012, land owners Dr. Kenneth Asselstine and Mary Jane Asselstine. The support is conditional on the successful purchase of the unopened road allowance between the proposed lot addition and Lot 24, Concession 3, consent application B/5/Nipissing/2012. Carried.

R2012-90 L. Smith, T. Piper: That we accept the correspondence as presented. Carried.

R2012-91 T. Butler, D. Culham: That the statement of accounts dated April 3, 2012 be approved. $68,856.34 Carried.

R2012-92 T. Piper, L. Smith: That we donate $100 to the Almaguin Highlands Secondary School Graduation Awards program for 2012. Carried.

R2012-93 T. Butler, D. Culham: That we donate $100 to the Trout Creek Agricultural Society for the 2012 Fall Fair. Carried.

R2012-94 L. Smith, T. Piper: That we pass By-Law No. 2012-20 being a by-law to confirm the proceedings of Council at its meeting held on April 3, 2012. Read the first, second and third time and passed this 3rd day of April, 2012. Carried.

R2012-95 D. Culham, T. Butler: That the meeting be adjourned. Time: 9:00 p.m. Next regular meeting April 17, 2012. Carried.
