A special meeting of the Township of Nipissing Council was held on Monday, July 28, 2008 called by Mayor Wendy Billingsley.

Present: Mayor Wendy Billingsley and Councillors Leslee Lawrence Straus, Pat Haufe, Dougal Culham , W. D. Russell and Charles Barton. Absent with regrets Councillor Young.

The meeting was called to order at 1:30 p.m.

L. Lawrence Straus; D. Culham: That we appoint Charles Barton to take the minutes of this meeting. Carried.

Disclosure of Pecuniary Interest: Leslee Lawrence Straus regarding purchase of unopened road allowance. Councillor Lawrence Straus left the room when this matter was discussed.

D. Culham; P. Haufe: That this part of our meeting will be closed to the public as authorized by Section 239(2) of the Municipal Act, 2001, c. 25, for consideration of the following subject matter: advice that is subject to solicitor-client privilege, including communications necessary for that purpose. Carried.

D. Culham; P. Haufe: That we resume the open public meeting. Time: 3:20 p.m. Carried.

D. Culham; L. Lawrence Straus: That we confirm the action taken on July 25, 2008 by Mayor Billingsley and Councillor Haufe authorized by Council at a Special meeting held July 22, 2008 with respect to the position of Clerk-Treasurer. Carried.

D. Culham; P. Haufe: That Council will rescind the resolution passed May 6, 2008 at the regular meeting of Council in which it was decided to support in principle an application submitted by Leslee Lawrence Straus for the closure of the unopened road allowance abutting property located at 606B South River Road, Concession A, Part Lot 218, Plan PSR2282, Part 26, Parcel 11064 N/S in the Township of Nipissing, District of Parry Sound.

D. Culham; P. Haufe: Whereas we have received Consent Application No. B/41/Nipissing/2008 submitted by Alan Stillar;

And Whereas the applicant’s lot was created by Consent Application No. 49C-870204 on March 16, 1988 submitted by the Applicant Everett Gibson;

And Whereas it was agreed that this would be the final severance from the subject property;

And Whereas the proposed severance does not front on a year round Township maintained road as required under Section 5.2.2(a) of the Township of Nipissing’s Official Plan;

And Whereas we have received a letter of concern regarding the subject severance;

Now Therefore we request that the North Almaguin Planning Board refuse to grant the proposed Consent Application.

P. Haufe; D. Culham: That the statement of accounts dated July 28, 2008 be approved. $110,635.57. Carried.

L. Lawrence Straus; P. Haufe: That the Council meeting be adjourned at 4:15 p.m.
