TOWNSHIP OF NIPISSING
Tuesday, July 14, 2015

A regular meeting of the Township of Nipissing Council was held on Tuesday, July 14, 2015.

Present: Mayor Pat Haufe and Councillors Dougal Culham, Tom Butler, Tom Piper and Liz Smith.

Staff and visitors present: Fred Welsh, Debbie Clark, Susan Cunningham, Paul Goodridge, Rob Serson, Dave Yemm, John-Paul Negrinotti, Kris Croskery-Hodgins and Charles Barton.

The meeting was called to order at 6:30 p.m.

R2015-131 T. Butler, D. Culham: That the minutes of the meeting held June 23, 2015 be adopted as published. Carried.

R2015-132 L. Smith, T. Piper: That the minutes of the closed session meeting held June 23, 2015 be adopted. Carried.

R2015-133 T. Piper, L. Smith: BE IT RESOLVED:
1. that this Council does approve “in principle” the Application of Shawn and Terra Degagne, Bear Creek Cottages, to purchase the Shore Road Allowance in front of their property, described as Lot 12, Con 17, 316A Bear Creek Road, Township of Nipissing.
2. that this resolution is subject to the following conditions:
• That the applicant will be responsible for the payment of all the Municipality’s administrative, legal accounts and advertising costs in connection with the processing of this application.
• That in accordance with the Municipality’s policy, notice and a copy of the draft plan will be mailed to the adjacent owners. Carried.

The meeting was declared a public meeting pursuant to the provisions of Section 34 (12) of the Planning Act, R.S.O., 1990, to discuss an application for a change to Zoning By-Law 2012-12 for 453 Green Acres Road.

R2015-134 D. Culham, T. Butler: That we pass By-Law No. 2015-22, being a By-law to amend Zoning By-Law 2012-12, as amended.
Read a first, second and third time and passed this 14th day of July, 2015. Carried.

R2015-135 L. Smith, T. Piper: That we pass By-Law Number 2015-23, being a By-law to permit the operation of off-road vehicles on highways under the jurisdiction of The Corporation of the Township of Nipissing.
Read a first, second and third time and passed this 14th day of July, 2015. Carried.

R2015-136 T. Butler, D. Culham: That we pass By-Law Number 2015-24, being a By-law to establish a schedule of retention periods for the records of The Corporation of the Township of Nipissing.
Read a first, second and third time and passed this 14th day of July, 2015. Carried.

R2015-137 L. Smith, T. Piper: That we authorize the CAO-Clerk, EDO-CEMC-Planning Assistant and the Mayor and Councillor Butler to attend the 2015 NE Ontario Planning Authorities Workshop, September 23-24 in Sudbury. Carried.

R2015-138 : That we award the Tender for Demolition of Commanda Storage Building to Evan Hughes Excavating for the amount of $4,949.40, including HST. Carried.

An Update on Wade’s Landing provided by the CAO-Clerk.

R2015-139 T. Piper, L. Smith: That we accept the correspondence as presented. Carried.

Councillor Tom Butler declared pecuniary interest as his spouse is an employee of the Township and is listed in the Payroll Payable and he is employed by the Near North District School Board which is listed in Accounts Payable.

R2015-140 D. Culham, T. Piper: That the statement of accounts dated: July 2, 9 & 14, 2015, totaling $377,690.87 , be approved. Carried.

R2015-141 T. Butler, D. Culham: That this part of our meeting will be closed to the public as authorized by Section 239(2) of the Municipal Act, 2001, c. 25, for consideration of the following subject matter:
e) litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board; Time: 7:47 p.m. Carried.

R2015-142 L. Smith, T. Piper: That we resume to an open public meeting. Time: 8:16 p.m. Carried.

R2015-143 D. Culham, T. Butler: That we accept the Trans Canada Trail routing option attached hereto as Appendix “A”. Carried.

R2015-144 T. Piper, L. Smith: That we commit $4,525 from Parkland Reserve for Phase One development of the JP Webster section of the Trans Canada Trail. Carried.

Councillor Butler declared a conflict of interest and refrained from voting on the next item as his Spouse is the Curator of the Nipissing Township Museum.

R2015-145 T. Piper, L. Smith: That we authorize the transfer of $1,000 from the Museum Capital Reserve to the working budget for the purchase of a new computer with programming and installation for the Nipissing Township Museum. Carried.

CAO-Clerk provided an overview of the proposed amendments to the Official Plan following the public meeting.

R2015-146 L. Smith, T. Piper: That we pass By-Law No. 2015-25, being a by-law to confirm the proceedings of Council at its meeting held on July 14, 2015. Read the first, second and third time and passed this 14th day of July, 2015. Carried.

R2015-147 D. Culham, T. Butler: That the meeting be adjourned. Time: 9:05 p.m. Next regular meeting August 11, 2015. Carried.
