A regular meeting of the Township of Nipissing Council was held on Tuesday, September 6, 2016.

Present: Mayor Tom Piper, Councillors Linda Andersen, Tom Butler, Tom Marchant and Liz Smith.

Staff and visitors present: Janet LeClair, Todd Daley, Dave Yemm, Earl McClanaghan, Steve Kirkey, John-Paul Negrinotti, Kris Croskery-Hodgins and Charles Barton.

The meeting was called to order at 6:30 p.m.

R2016-178 T. Butler, L. Andersen: That the minutes of the special meeting held August 11, 2016 be adopted as published. Carried.

R2016-179 T. Marchant, L. Smith: That the minutes of the closed session meeting held August 11, 2016 be adopted. Carried.

R2016-180 L. Andersen, T. Butler: That we pass By-Law Number 2016-43, being a By-law to adopt a revised compensation pay equity report for the Township of Nipissing.

R2016-181 L. Smith, T. Marchant: That we pass By-Law Number 2016-44, being a By-law to adopt a Code of Conduct for the Council, for the Members of Council in the Township of Nipissing.

R2016-182 T. Butler, L. Andersen: That we pass By-Law Number 2016-45, being a By-law to enter into a Mutual Service Agreement with the Township of Bonfield, Municipality of Callander, Township of Chisholm, Municipality of East Ferris and the Municipality of Powassan.

R2016-183 T. Marchant, L. Smith: That we pass By-Law Number 2016-46, being a by-law to provide for fees charged by the Corporation of the Township of Nipissing.
Read a first, second and third time and passed this 6th day of September, 2016. Carried.

R2016-184 L. Smith, T. Marchant: That we pass By-Law Number 2016-47, being a By-law to establish a board of Management for the Nipissing Township Museum.
Read a first, second and third time and passed this 6th day of September, 2016. Carried.

R2016-185 T. Butler, L. Andersen: WHEREAS Council for The Corporation of the Township of Nipissing supports the cross-appointment of the Deputy Fire Chief positions between the Township of Nipissing and Municipality of Callander in order to establish a Senior Officer on-call rotation for both municipalities;
AND WHEREAS the duties and assignments of the Deputy Fire Chief positions will be at the discretion of the Fire Chief, namely on-call for both municipalities;
AND WHEREAS it is understood and agreed by the Township of Nipissing and the Municipality of Callander that the Township of Nipissing will not compensate the Callander Deputy Fire Chief, nor will he be an employee of the Township of Nipissing;
AND WHEREAS it is understood and agreed by the Township of Nipissing and the Municipality of Callander that the Municipality of Callander will not compensate the Nipissing Deputy Fire Chief, nor will he be an employee of the Municipality of Callander;
THEREFORE BE IT RESOLVED:
A. That Council for the Corporation of the Township of Nipissing authorizes the Mayor and CAO-Clerk to execute an Agreement for the Shared Deputy Fire Chief services as needed between the Township of Nipissing and the Municipality of Callander. Carried.

R2016-186 T. Marchant, L. Smith: That we pass By-Law Number 2016-48, being a By-Law to appoint a Deputy Fire Chief for the Township of Nipissing Fire Department.
Read a first, second and third time and passed this 6th day of September, 2016. Carried.

R2016-187 L. Andersen, T. Butler: BE IT RESOLVED:
1. That this Council does approve “in principle” the Application of Hans Peter Schwarzkopf and Elisabeth Schwarzkopf, to purchase the Shore Road Allowance in front of their property, described as Plan M146, Lot 8, PCL 7226 N/S, Township of Nipissing.
2. That this resolution is subject to the following conditions:
• The Council shall select an independent search firm specializing in fishery issues and environmental issues to complete an independent investigation and report to determine the geographic limits where development could occur and to ensure compliance to the Provincial Policy Statement.
• That the applicant will be responsible for the payment of all the Municipality’s administrative, legal accounts and Environmental Impact Study costs in connection with the processing of this application.
• That in accordance with the Municipality’s policy, notice and a copy of the draft plan will be mailed to the adjacent owners. Carried.

R2016-188 L. Smith, T. Marchant: WHEREAS the owner of lot 176 Concession A formerly in the Township of Gurd has offered to convey part of the Alsace Road and part of the Barret Road which crosses the property to the Township of Nipissing for road purposes;
AND WHEREAS the Township Official Plan policy is to acquire title to the roads that have historically been used and maintained as public roads in the Township but have not been dedicated as public highways;
NOW THEREFORE the Township is willing to accept a minimum of 10 metres on either side of the existing road centerline to the Municipality for road purposes. Carried.

Council reviewed the final draft of the Fall 2016 Newsletter.

R2016-189 T. Butler, L. Andersen: That we appoint Tom Marchant as a Livestock Valuer for the Township of Nipissing. Carried.

R2016-190 T. Marchant, L. Smith: That we accept the correspondence as presented. Carried.

R2016-191 L. Andersen, T. Butler: That the statement of accounts dated August 11 and 26, September 2 and 6, 2016; totaling $170,448.55, be approved. Carried.

R2016-192 L. Smith, T. Marchant: That this part of our meeting will be closed to the public as authorized by Section 239(2) of the Municipal Act, 2001, c. 25, for consideration of the following subject matter:
c) a proposed or pending acquisition or disposition of land by the municipality or local boards.

R2016-193 T. Butler, L. Andersen: That we resume to an open public meeting. Time: 8:32 p.m. Carried.

R2016-194 L. Andersen, T. Butler: That we accept the resignation of Michelle Thornton Robinson from the Nipissing Township Museum Board. Carried.

R2016-195 T. Marchant, L. Smith: That we accept the resignation of Karin Ann Brent from the Nipissing Township Museum Board. Carried.

R2016-196 L. Smith, T. Marchant: That the Council of the Township of Nipissing authorizes Discovery Routes Trail Organization to obtain quotations for improvements to the pedestrian access trail to the JP Webster Nature Preserve. Carried.

R2016-197 L. Andersen, T. Butler: That we authorize the Treasurer-Deputy Clerk to attend the AMCTO Zone 7 Fall Workshop in Sudbury. Carried.

R2016-198 L. Smith, T. Marchant: That we accept the quote from Ben’s Plumbing and Heating for the supply and install of a propane furnace at Fire Station #2 in the amount of $4,900.00 plus applicable taxes. Carried.

R2016-199 T. Butler, L. Andersen: That we pass By-Law No. 2016-49, being a by-law to confirm the proceedings of Council at its meeting held on September 6, 2016. Read the first, second and third time and passed this 6th day of September, 2016. Carried.

R2016-200 T. Marchant, L. Smith: That the meeting be adjourned. Time: 8:51 p.m. Next regular meeting September 20, 2016. Carried.
